Had a think about natural 1s – my thoughts are that as you level up, the chances of epic failing should diminish, not disappear. Therefore, how about this system:

For every d20 roll, a natural 1 has a 1 in lvl/4 rounded down (minimum 1) chance of failing.
Thus when a 1 is rolled:
Lvl 1-7 1/1 chance of failing (automatically confirms)
Lvl 8-11 1/2 chance of failing (50% chance of confirming)
Lvl 12-15 1/3 chance of failing (33% chance of confirming)
Lvl 16-19 1/4 chance of failing (25% chance of confirming)
Lvl 20+ 1/5 chance of failing (20% chance of confirming)

This effectively means that a level 20 BBEG has a 1 in 100 chance of failing a roll, while level 12 people have a 1 in 60 chance.

If you do not confirm the fail, take a -10 penalty instead.
